IRCC had informed the Applicant that they were<strong> ineligible<\/strong> for the points they received due to an error where 50 points were incorrectly awarded for holding a certificate of qualification.<\/p>\n\n\n\n<p>Removing those 50 points, the Applicant&#8217;s score dropped below the range of what was being selected. However, during the review of the Applicant&#8217;s initial file, it became apparent that there had been a <strong>mistaken interpretation<\/strong> of two questions in the CRS. Because those questions were misinterpreted by the Applicant while she was a self-rep, <strong>she missed out on additional points that would have put her over the draw scores (notwithstanding the 50 points given in error).<\/strong><\/p>\n\n\n\n<p>Finally, there was a challenge with the Applicant&#8217;s educational credential that needed to be navigated. The Applicant held a PGWP but was awarded it not for a Master&#8217;s Degree but for an entry-to-practice professional degree. The nature of the program was a grey area, but after legal analysis, <strong>there were strong grounds to rely on IRCC&#8217;s awarding of a PGWP and the program to claim the additional CRS points<\/strong>.<\/p>\n\n\n\n<p>The Applicant is now able to pursue their professional career in Canada with the peace of mind of permanent resident status and hopefully citizenship shortly.
