{"id":9631,"date":"2023-02-23T15:13:27","date_gmt":"2023-02-23T23:13:27","guid":{"rendered":"https:\/\/heronlaw.ca\/ircc-officer-error-blurring-lines-between-post-graduate-work-permit-eligibility-and-the-actively-pursuing-studies-requirement\/"},"modified":"2023-02-23T15:13:27","modified_gmt":"2023-02-23T23:13:27","slug":"ircc-officer-error-blurring-lines-between-post-graduate-work-permit-eligibility-and-the-actively-pursuing-studies-requirement","status":"publish","type":"post","link":"https:\/\/heronlaw.ca\/zh-hans\/ircc-officer-error-blurring-lines-between-post-graduate-work-permit-eligibility-and-the-actively-pursuing-studies-requirement\/","title":{"rendered":"IRCC Officer Error &#8211; Blurring Lines Between Post-Graduate Work Permit Eligibility and the Actively-Pursuing Studies Requirement"},"content":{"rendered":"\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" width=\"640\" height=\"452\" src=\"https:\/\/heronlaw.ca\/wp-content\/uploads\/2023\/02\/right-wrong.png\" alt=\"\" class=\"wp-image-3594\" srcset=\"https:\/\/heronlaw.ca\/wp-content\/uploads\/2023\/02\/right-wrong.png 640w, https:\/\/heronlaw.ca\/wp-content\/uploads\/2023\/02\/right-wrong-300x212.png 300w\" sizes=\"(max-width: 640px) 100vw, 640px\" \/><\/figure>\n\n\n\n<p>In this blog post, we want to briefly share a refusal decision we have seen in our office recently on a post-graduate work permit (restoration) refusal and highlight where this decision is both wrong and problematic.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>The refusal letter is below:<\/p>\n\n\n\n<figure class=\"wp-block-image\"><a href=\"https:\/\/vancouverimmigrationblog.com\/?attachment_id=6971\"><img src=\"http:\/\/vancouverimmigrationblog.com\/wp-content\/uploads\/2023\/02\/Refusal-without-status-and-ineligible-for-restoration.jpg\" alt=\"\" class=\"wp-image-6971\"\/><\/a><\/figure>\n\n\n\n<p><\/p>\n\n\n\n<p>The Officer in this case appears to have refused the Applicant (per my last Heron <a href=\"https:\/\/heronlaw.ca\/restoration-for-actively-pursuing-studies\/\">blog post<\/a>)&nbsp;because of R. 182(2) <em>IRPR <\/em>which prohibits the restoration of a student who is not in compliance with R.220.1(1) <em>IRPR <\/em>from having their status restored.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>However, if we look at the regulatory provision:<\/p>\n\n\n\n<p>Conditions \u2014 study permit holder<\/p>\n\n\n\n<ul id=\"689281\"><li><strong><a><strong>220.1<\/strong><\/a><\/strong>&nbsp;<strong>(1)<\/strong>&nbsp;The holder of a study permit in Canada is subject to the following conditions:<ul><li><strong>(a)<\/strong>&nbsp;they shall enroll at a designated learning institution and <strong>remain enrolled<\/strong> at a designated learning institution until they complete their studies; and<\/li><li><strong>(b)<\/strong>&nbsp;they shall actively pursue their course or program of study.<\/li><\/ul><\/li><\/ul>\n\n\n\n<p><strong>(emphasis added)<\/strong><\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>Recall also the policy interpretation <a href=\"https:\/\/www.canada.ca\/en\/immigration-refugees-citizenship\/corporate\/publications-manuals\/operational-bulletins-manuals\/temporary-residents\/study-permits\/assessing-conditions.html\">here<\/a> (reproduced below):<\/p>\n\n\n\n<h4 id=\"full-part-studies\">A. Full-time and part-time studies<\/h4>\n\n\n\n<p>From an Immigration, Refugees and Citizenship Canada&nbsp;(IRCC) perspective, at a minimum, student<strong>s must have part-time status with their institution to be considered to be actively pursuing their studies.<\/strong><\/p>\n\n\n\n<p>The province of Quebec requires students to maintain full-time status with their institution to be considered to be actively pursuing their studies. See more details on&nbsp;<a href=\"https:\/\/www.immigration-quebec.gouv.qc.ca\/en\/immigrate-settle\/students\/obtaining-authorizations\/requirements\/prerequisites.html\">requirements for students in Quebec<\/a>.<\/p>\n\n\n\n<p>For more information on full-time and part-time studies, see&nbsp;<a href=\"https:\/\/www.canada.ca\/en\/immigration-refugees-citizenship\/corporate\/publications-manuals\/operational-bulletins-manuals\/temporary-residents\/study-permits\/other-considerations.html\">Study permits: Other considerations<\/a><\/p>\n\n\n\n<p><strong>(emphasis added)<\/strong><\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>What the IRCC Officer has done (in essence) is mix the requirements for full-time enrollment for PGWP eligibility with the actively-pursuing requirements posted <a href=\"https:\/\/www.canada.ca\/en\/immigration-refugees-citizenship\/corporate\/publications-manuals\/operational-bulletins-manuals\/temporary-residents\/study-permits\/post-graduation-work-permit-program\/eligibility.html\">here<\/a>, and re-produced in part below:<\/p>\n\n\n\n<p>To obtain a post-graduation work permit, the applicant must currently hold valid temporary status or have left Canada. They must have graduated from an&nbsp;<a href=\"https:\/\/www.canada.ca\/en\/immigration-refugees-citizenship\/corporate\/publications-manuals\/operational-bulletins-manuals\/temporary-residents\/study-permits\/post-graduation-work-permit-program\/institutions.html#eligible\">eligible designated learning institution&nbsp;(DLI)<\/a>. They must also submit clear evidence that they meet all of the following criteria:<\/p>\n\n\n\n<ul><li>They have completed an academic, vocational or professional training program at an eligible institution&nbsp;<strong>in Canada<\/strong>&nbsp;that is at least&nbsp;<strong>8&nbsp;months in duration<\/strong>&nbsp;leading to a degree, diploma or certificate.<\/li><li>They have maintained&nbsp;<strong>full-time student status in Canada<\/strong>&nbsp;during each academic session of the program or programs of study they have completed and submitted as part of their post-graduation work permit application. Exceptions can be made only for the following:<ul><li><a href=\"https:\/\/www.canada.ca\/en\/immigration-refugees-citizenship\/corporate\/publications-manuals\/operational-bulletins-manuals\/temporary-residents\/study-permits\/post-graduation-work-permit-program\/eligibility.html#leave_from_studies\">leave from studies<\/a><\/li><li><a href=\"https:\/\/www.canada.ca\/en\/immigration-refugees-citizenship\/corporate\/publications-manuals\/operational-bulletins-manuals\/temporary-residents\/study-permits\/post-graduation-work-permit-program\/eligibility.html#final_academic_session\">final academic session<\/a><\/li><\/ul><\/li><li>They have received a transcript and an official letter from the eligible DLI confirming that they have met the requirements to complete their program of study.<\/li><li><strong>Note:<\/strong>&nbsp;The transcript and official letter must be included in a post-graduation work permit application<\/li><\/ul>\n\n\n\n<p><strong>(emphasis in original)<\/strong><\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>How many students has this particular officer sent this refusal letter to? Who reviewed the template language? <\/p>\n\n\n\n<p>These are questions that will need to be answered.
