I recently performed an ATIP where I asked for and received IRCC&#8217;s processing manual for Chinook. Unsurprisingly, it was highly redacted so in writing this piece we have blanks to fill in, but definitely tons of material to speculate over.<\/p>\n\n\n\n<p>Can&#8217;t wait to dork out? Me too. Let&#8217;s go.<\/p>\n\n\n\n<div style=\"height:100px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h1>Three Things the Chinook+ Processing Manual Tells Us<\/h1>\n\n\n\n<h2><strong>1.<\/strong> <strong>There&#8217;s a Running Total Track for Officer&#8217;s Files, Approvals, and Refusals<\/strong><\/h2>\n\n\n\n<p>The significance of this finding is that we had premonitions based on only seeing the excel role of one sample client in the Daponte Affidavit that there likely was some sort of systematic way that Officers were tracking decisions made to try and maintain some or balance. If they are told not to process 25 applications at a time through this, and we have learned through parallel access to information requests that Officers are to spend 11 minutes on a file (inside Canada), we wonder how many files Officers are asked to process a day. <\/p>\n\n\n\n<p>In a high-volume visa office such as Delhi or Ankara, we would not be surprised the numbers would be in the hundreds (possibly in the 200s &#8211; 300s). How does Chinook set up that mass processing and, subsequently, how does that affect whether each filed is properly reviewed or how files are not confused or mixed up with one another, as my colleague and friend Zeynab Ziaie <a href=\"https:\/\/www.thestar.com\/news\/canada\/2021\/11\/15\/canada-is-refusing-more-study-permits-is-new-ai-technology-to-blame.html\">recently told the Toronto Star.<\/a><\/p>\n\n\n\n<p>Again, using the marking exams theme that I mentioned, it&#8217;s hard not to process with the overall progress bar in mind.<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" width=\"897\" height=\"437\" src=\"https:\/\/heronlaw.ca\/wp-content\/uploads\/2021\/11\/Progress-Bar.png\" alt=\"\" class=\"wp-image-2360\" srcset=\"https:\/\/heronlaw.ca\/wp-content\/uploads\/2021\/11\/Progress-Bar.png 897w, https:\/\/heronlaw.ca\/wp-content\/uploads\/2021\/11\/Progress-Bar-300x146.png 300w, https:\/\/heronlaw.ca\/wp-content\/uploads\/2021\/11\/Progress-Bar-768x374.png 768w\" sizes=\"(max-width: 897px) 100vw, 897px\" \/><\/figure>\n\n\n\n<h2><strong>2.<\/strong> <strong>Chinook Promotes the Use of Standard Form Refusals Utilizing Logic<\/strong> <strong>(Hard to Argue this is Not AI)<\/strong><\/h2>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" width=\"971\" height=\"414\" src=\"https:\/\/heronlaw.ca\/wp-content\/uploads\/2021\/11\/refusal-grounds.png\" alt=\"\" class=\"wp-image-2352\" srcset=\"https:\/\/heronlaw.ca\/wp-content\/uploads\/2021\/11\/refusal-grounds.png 971w, https:\/\/heronlaw.ca\/wp-content\/uploads\/2021\/11\/refusal-grounds-300x128.png 300w, https:\/\/heronlaw.ca\/wp-content\/uploads\/2021\/11\/refusal-grounds-768x327.png 768w\" sizes=\"(max-width: 971px) 100vw, 971px\" \/><figcaption>IRCC&#8217;s generic refusal checkbox is the default to automatically generate a refusal letter. Mario Bellissimo in speaking about Chinook has been discussing the possibility that files could be organized to filter cases of a like-type (such as anybody over 30) could be processed together. Doing so could also support the generation of the same reasons for refusal in these like cases. Form mistakes could lead to refusal<\/li><li><strong>Employment\/Education History Matters<\/strong> &#8211; gone are the days of using attachment tables solely. The forms need to do the best job possible of presenting this.<\/li><li><strong>Previous GCMS History Matters<\/strong> &#8211; in addition to employment\/education, the previous GCMS history will show up. Failure to address previous refusal or inconsistency could lead to refusal.<\/li><\/ol>\n\n\n\n<p><\/p>\n\n\n\n<p>Furthermore we learn from the processing manual that there is &#8220;Logic&#8221; involved and what appears to be a decision tree. There&#8217;s a Lack of Transparency on the Working Notes (Sticky Notes Versus Something More?)<\/strong><\/h2>\n\n\n\n<p>In the processing manual we learn what a working note is. While there is an example of a simple working note &#8216;review employment documents&#8217; &#8211; there also appears to be the use of the post-it note to mark particular or specific actions.<\/p>\n\n\n\n<figure class=\"wp-duotone-000000-fcb900-1 wp-block-image size-full is-resized\"><img loading=\"lazy\" src=\"https:\/\/heronlaw.ca\/wp-content\/uploads\/2021\/11\/working-note.png\" alt=\"\" class=\"wp-image-2353\" width=\"804\" height=\"129\" srcset=\"https:\/\/heronlaw.ca\/wp-content\/uploads\/2021\/11\/working-note.png 804w, https:\/\/heronlaw.ca\/wp-content\/uploads\/2021\/11\/working-note-300x48.png 300w, https:\/\/heronlaw.ca\/wp-content\/uploads\/2021\/11\/working-note-768x123.png 768w\" sizes=\"(max-width: 804px) 100vw, 804px\" \/><\/figure>\n\n\n\n<p>This is somewhat in contrast to sworn cross-examination provided by Daponte, which suggests there is nothing specific to the notes.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" width=\"1024\" height=\"381\" src=\"https:\/\/heronlaw.ca\/wp-content\/uploads\/2021\/11\/stick-note-Daponte-affidavit-1024x381.png\" alt=\"\" class=\"wp-image-2354\" srcset=\"https:\/\/heronlaw.ca\/wp-content\/uploads\/2021\/11\/stick-note-Daponte-affidavit-1024x381.png 1024w, https:\/\/heronlaw.ca\/wp-content\/uploads\/2021\/11\/stick-note-Daponte-affidavit-300x112.png 300w, https:\/\/heronlaw.ca\/wp-content\/uploads\/2021\/11\/stick-note-Daponte-affidavit-768x286.png 768w, https:\/\/heronlaw.ca\/wp-content\/uploads\/2021\/11\/stick-note-Daponte-affidavit.png 1135w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><figcaption>Daponte&#8217;s Affidavit suggest there is &#8216;nothing specific&#8217; to the little scribbles that make up the working notes.<\/figcaption><\/figure>\n\n\n\n<p>I would suggest that it appears the &#8216;working notes&#8217; may be more important (and therefore their subsequent deletion more important) than the Daponte cross-examination lets on.<\/p>\n\n\n\n<p>Taking a look into the GCMS export information, a further question comes up:<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" width=\"1024\" height=\"446\" src=\"https:\/\/heronlaw.ca\/wp-content\/uploads\/2021\/11\/pasting-notes-from-chinook-into-notes-tab-1-1024x446.png\" alt=\"\" class=\"wp-image-2358\" srcset=\"https:\/\/heronlaw.ca\/wp-content\/uploads\/2021\/11\/pasting-notes-from-chinook-into-notes-tab-1-1024x446.png 1024w, https:\/\/heronlaw.ca\/wp-content\/uploads\/2021\/11\/pasting-notes-from-chinook-into-notes-tab-1-300x131.png 300w, https:\/\/heronlaw.ca\/wp-content\/uploads\/2021\/11\/pasting-notes-from-chinook-into-notes-tab-1-768x335.png 768w, https:\/\/heronlaw.ca\/wp-content\/uploads\/2021\/11\/pasting-notes-from-chinook-into-notes-tab-1.png 1513w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><figcaption>Note the difference between Notes Tab (which presumably fill the GCMS notes section) and Working Notes. I query as to how those two are sorted or distinguished. Indeed, more recent ATIPs from Chinook countries (those that employ Chinook more fully) have very limited Notes sections. Presumably, the Officer is doing more than tracking &#8220;see LOA&#8221; or the other standard refusal reasons.<\/figcaption><\/figure>\n\n\n\n<p>One of the major concerns I have is whether there is a safeguard or mechanism in place to ensure or define the difference between &#8220;Working Notes&#8221; and what is punted into the &#8220;Notes Tab.&#8221; Indeed with the way the Working Notes are defined and promoted as deleted, would there not be impetus to hide the type of commentary that would give rise to concern as a Working Note and save the Notes Tab for the standard form refusal language. It certainly appears so.<\/p>\n\n\n\n<div style=\"height:100px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h1><strong>Read For Yourself: IRCC&#8217;s Chinook Processing Manual<\/strong><\/h1>\n\n\n<a href=\"https:\/\/heronlaw.ca\/wp-content\/uploads\/2021\/11\/2A202167625_finalrelease.pdf\" class=\"pdfemb-viewer\" style=\"\" data-width=\"max\" data-height=\"max\"  data-toolbar=\"bottom\" data-toolbar-fixed=\"off\">2A202167625_finalrelease<br\/><\/a>\n<p class=\"wp-block-pdfemb-pdf-embedder-viewer\"><\/p>\n\n\n\n<p>Have a ready for yourself.
