{"id":9710,"date":"2021-08-06T10:59:23","date_gmt":"2021-08-06T17:59:23","guid":{"rendered":"https:\/\/heronlaw.ca\/counsel-notice-if-you-see-ocran-cited-in-your-federal-court-cases-please-contact-us\/"},"modified":"2021-08-06T10:59:23","modified_gmt":"2021-08-06T17:59:23","slug":"counsel-notice-if-you-see-ocran-cited-in-your-federal-court-cases-please-contact-us","status":"publish","type":"post","link":"https:\/\/heronlaw.ca\/zh-hans\/counsel-notice-if-you-see-ocran-cited-in-your-federal-court-cases-please-contact-us\/","title":{"rendered":"Counsel Notice: If You See Ocran Cited in Your Federal Court Cases Please Contact Us"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\">We are cross-examining IRCC on their process of refusing temporary residence applications.<\/h2>\n\n\n\n<p>Dear Canadian Immigration Counsel:<\/p>\n\n\n\n<p>If you have been engaged in judicial reviews of temporary residence applications you have probably have seen something like this recently:<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img fetchpriority=\"high\" decoding=\"async\" width=\"1024\" height=\"500\" src=\"https:\/\/heronlaw.ca\/wp-content\/uploads\/2021\/08\/Ocran-disclosure-1024x500.png\" alt=\"\" class=\"wp-image-2028\" srcset=\"https:\/\/heronlaw.ca\/wp-content\/uploads\/2021\/08\/Ocran-disclosure-1024x500.png 1024w, https:\/\/heronlaw.ca\/wp-content\/uploads\/2021\/08\/Ocran-disclosure-300x146.png 300w, https:\/\/heronlaw.ca\/wp-content\/uploads\/2021\/08\/Ocran-disclosure-768x375.png 768w, https:\/\/heronlaw.ca\/wp-content\/uploads\/2021\/08\/Ocran-disclosure.png 1115w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<p>While the Department of Justice&#8217;s position is that this <span style=\"text-decoration: underline;\">does not<\/span> affect the merits of the underlying decision, there is much more than meets the eye. The technical affidavit DOJ is filing (please <a href=\"mailto:info@heronlaw.ca\">email<\/a> us for a copy) attempts to justify IRCC&#8217;s process for refusing temporary resident applications. <\/p>\n\n\n\n<p>They are being filed in temporary resident matters specifically to set up an argument that the reasons for refusal are limited to templated language and therefore cannot provide a detailed Officer&#8217;s assessment. Please read Will Tao&#8217;s blog post <a href=\"https:\/\/vancouverimmigrationblog.com\/three-things-you-likely-dont-but-should-know-about-how-ircc-assesses-your-study-permit-application\/\">here<\/a> for context. If they are able to get endorsement from the Court in <em>Ocran<\/em> <em>(<\/em>IMM-6571-20) they will likely seek to get similar judicial treatment in other cases. <\/p>\n\n\n\n<p>Several Toronto-based lawyers for the Department of Justice are collaborating on this case and have recently switched gears after initially planning to utilize another test case from earlier this year.<\/p>\n\n\n\n<p>If templated decisions (GCMS notes\/Rule 9 Reasons) become the norm, expect this to make it very difficult for your clients to challenge refusals and respond to procedural fairness letters.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Cross-Examining IRCC<\/h2>\n\n\n\n<p>We have been working with very competent counsel in <em>Ocran<\/em> in seeking to cross-examine IRCC. Within the limitations of cross-examinations and the technical issues involved, one cross-examination will not be enough. These cross-examinations will also need to be carefully coordinated and curated to dissect the various elements.
