Even on those grounds, with a lack of travel history being continually re-enforced as, at most a neutral factor (see e.g. Justice Ahmed\u2019s comments in\u00a0<i>Adom v Canada (Citizenship and Immigration),\u00a0<\/i>2019 FC 26\u00a0<a href=\"http:\/\/canlii.ca\/t\/hwx6m\">http:\/\/canlii.ca\/t\/hwx6m<\/a>\u00a0at para 15), there are becoming fewer and fewer ways for IRCC to actually substantiate that an individual will not leave Canada at the end of their authorized stay.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-0da48d9 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"0da48d9\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-82294c5\" data-id=\"82294c5\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-44eba99 elementor-widget elementor-widget-text-editor\" data-id=\"44eba99\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<p>One of the common ways Officers wish to do this is by highlighting\u00a0<strong>family ties<\/strong>\u00a0as a reason for refusal. Argument is that because an individual has family in Canada (either other family members or relatives on permits, as permanent residents, or citizens) that they will not leave Canada. This can also be demonstrated by showing the Applicant is not leaving or leaving limited family members behind in their country of origin\/residence.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-85902c8 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"85902c8\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-955e46a\" data-id=\"955e46a\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-5474788 elementor-widget elementor-widget-text-editor\" data-id=\"5474788\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<p>One way this is often addressed in the context of someone visiting their Canadian spouse (for example) is to put in a dual intention argument.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-d838003 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"d838003\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-899f900\" data-id=\"899f900\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-2bea48f elementor-widget elementor-widget-text-editor\" data-id=\"2bea48f\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<p>I have written previously on the need to exercise caution when claiming dual intention, especially when there is not a clear or immediate pathway to permanent residence for international students.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-64c6ed8 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"64c6ed8\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-0262f69\" data-id=\"0262f69\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-cb1b206 elementor-widget elementor-widget-heading\" data-id=\"cb1b206\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Exercise Caution When Claiming Dual Intent on Study Permit Applications \u2013 International Students<\/h2>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-945bf7e qoutes elementor-widget elementor-widget-text-editor\" data-id=\"945bf7e\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<p>Dual intent is an important and increasing oft-used provision of the<em>\u00a0Immigration and Refugee Protection Act\u00a0<\/em>(\u201cIRPA\u201d) particularly for those applicants who straddle the pathway between temporary and permanent residence. I\u00a0<a href=\"http:\/\/vancouverimmigrationblog.com\/dual-intention-fc-in-jewell-reinforces-that-it-is-more-than-a-buzzword\/\">previously wrote about this concept<\/a>\u00a0more than four years ago<span id=\"more-1839\"><\/span>\u00a0with respect to a Federal Court case I was involved with called\u00a0<em>Jewell<\/em>.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-373ed89 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"373ed89\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-83af6e7\" data-id=\"83af6e7\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-7b6ce19 elementor-widget elementor-widget-text-editor\" data-id=\"7b6ce19\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<p><span style=\"text-decoration: underline;\"><strong>The Law<\/strong><\/span><\/p>\n<p>Section 22(2) of IRPA sets out:<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-13e8df4 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"13e8df4\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-948dca9\" data-id=\"948dca9\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-ba1d227 quotes elementor-widget elementor-widget-text-editor\" data-id=\"ba1d227\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<p class=\"MarginalNote\"><em>Temporary resident<\/em><\/p>\n<p class=\"Subsection\"><em><strong><span class=\"sectionLabel\">22<\/span><\/strong>\u00a0<span class=\"lawlabel\">(1)<\/span>\u00a0A foreign national becomes a temporary resident if an officer is satisfied that the foreign national has applied for that status, has met the obligations set out in paragraph 20(1)(b), is not inadmissible and is not the subject of a declaration made under subsection 22.1(1).<\/em><\/p>\n<p class=\"Subsection\"><em><span class=\"wb-invisible\">Marginal note:\u00a0<\/span>Dual intent<\/em><\/p>\n<p class=\"Subsection\"><em><span class=\"lawlabel\">(2)<\/span>\u00a0An intention by a foreign national to become a permanent resident does not preclude them from becoming a temporary resident if the officer is satisfied that they will leave Canada by the end of the period authorized for their stay.<\/em><\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-ae22d70 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"ae22d70\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-64382ae\" data-id=\"64382ae\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-2e819dc elementor-widget elementor-widget-text-editor\" data-id=\"2e819dc\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<p><span style=\"text-decoration: underline;\"><strong>Is Dual Intention Applicable to Study Permit Applications? Is it Over-relied Upon?<\/strong><\/span><\/p>\n<p>Dual intent seems naturally applicable in the context of a spouse who seeks a visa or temporary entry into Canada while a permanent residence application is in process or a foreign worker seeking to extend a temporary work permit while awaiting an Application for Permanent Residence based on an Express Entry Application or Provincial Nomination Program nomination.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-2ae46ec elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"2ae46ec\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-887c091\" data-id=\"887c091\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-f25d5ea elementor-widget elementor-widget-text-editor\" data-id=\"f25d5ea\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<p>Recently in reviewing study permit applications made by international students, including those prepared by prominent and experienced authorized representatives, I realized that dual intention was being heavily relied on. Indeed, Minister Hussen in several speeches given last year about international students, seemed to suggest that it was no inappropriate for students to enter Canada with an ambition to eventually become permanent residents.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-76ef741 elementor-widget elementor-widget-text-editor\" data-id=\"76ef741\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<p>However, in this piece, I want to put a cautionary tale on the application of dual intention when the future intention (permanent residence) is years away and argue that any submissions on study permit applications should focus instead on future immigration compliance and strengthened\/remaining ties to the country of citizenship and or permanent residence (if not Canada). I also believe that much of our over-focus on dual intention can also be inadvertently created by our own pathwaying (as representatives) of the permanent residence process.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-65ce0fc elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"65ce0fc\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-4aa19eb\" data-id=\"4aa19eb\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-d3b2cbf elementor-widget elementor-widget-text-editor\" data-id=\"d3b2cbf\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<p><span style=\"text-decoration: underline;\"><strong>IRCC\u2019s Program Delivery Instructions on Dual Intention<\/strong><\/span><\/p>\n<p>IRCC has published instructions (as of the date of this post, last modified in March 2019). These instructions are quite detailed and worth a detailed read.<\/p>\n<p>While the instructions set out it is not impermissible to have two intentions (one permanent and one temporary) and that it cannot be a standalone basis for refusal. The section titled \u2018<em>Example of a case for refusal<strong>\u2018\u00a0<\/strong><\/em>sheds important light on the concept, especially in the study permit concept.<\/p>\n<p>The instructions state:<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-c047dcb elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"c047dcb\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-9d808d1\" data-id=\"9d808d1\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-06ea22b quotes elementor-widget elementor-widget-text-editor\" data-id=\"06ea22b\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<div class=\"well\">\n<p><em>An applicant for a work or study permit who indicates that\u00a0t<span style=\"text-decoration: underline;\">hey have no intention of leaving Canada<\/span>\u00a0has demonstrated only a single intent \u2013 permanent residence. Their application would be refused, even if the applicant might subsequently qualify for the Canadian experience class (CEC) or the Provincial Nominee Program (PNP).\u00a0<span style=\"text-decoration: underline;\">This is because the applicant has shown that they would not respect the terms and conditions of temporary residence, should they not qualify for permanent residence.<\/span><\/em><\/p>\n<\/div>\n<p><em>Section R179 is balanced by the flexibility of subsection A22(2), which allows the officer to consider an applicant\u2019s\u00a0<strong>intent\u00a0<\/strong>in relation to the particular circumstances of the application.\u00a0<span style=\"text-decoration: underline;\">For example: an applicant for a study permit who may qualify for the CEC in 3 years has a different set of circumstances from that of a provincial nominee whose application is near completion and who applies for a work permit<\/span>, with the support of the province, due to an urgent need for their services. Please note that all applications should be assessed on their individual merits.<\/em><\/p>\n<p>(<span style=\"text-decoration: underline;\"><em>emphasis<\/em>\u00a0added<\/span>)<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-50a1af9 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"50a1af9\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-8b5487b\" data-id=\"8b5487b\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-f0ab845 elementor-widget elementor-widget-text-editor\" data-id=\"f0ab845\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<p>The\u00a0<strong>very\u00a0<\/strong>examples provided by IRCC about when refusing an applicant may be appropriate focus on the international study permit applicant who is not eligible for permanent residency at the time of their application.\u00a0 Furthermore, these instructions seem to suggest intent (where absent) can be imputed.<\/p>\n<p>Therefore, even if the facts are presented in a balanced way \u2013 for example, half the family is in Canada vs. half the family is in the country<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-cb7ce56 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"cb7ce56\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-b76c411\" data-id=\"b76c411\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-a34423b elementor-widget elementor-widget-text-editor\" data-id=\"a34423b\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<p>I am still debating whether I am of this opinion, as there has been some recent positive case law (see:\u00a0<i>Bteich v Canada (Citizenship and Immigration),\u00a0<\/i>2019 FC 1230\u00a0\u00a0<a href=\"http:\/\/canlii.ca\/t\/j2kzr\">http:\/\/canlii.ca\/t\/j2kzr<\/a>). My opinion has shifted in that I do think a case-by-case assessment should take place. I will address this case below.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-62e7eba elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"62e7eba\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-b4db360\" data-id=\"b4db360\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-56ebe20 elementor-widget elementor-widget-text-editor\" data-id=\"56ebe20\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<p><strong>Addressing Family Ties<\/strong><\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c514722 elementor-widget elementor-widget-text-editor\" data-id=\"c514722\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<p>In the section that follows I\u00a0 want to highlight a few strong cases from the Applicant\u2019s side before looking at one case that the Department of Justice may lean on.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-3092da8 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"3092da8\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-7ac5311\" data-id=\"7ac5311\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-a7ba07d elementor-widget elementor-widget-text-editor\" data-id=\"a7ba07d\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<p>In the aforementioned,\u00a0<em><strong>Bteich<\/strong><\/em><i><strong><em>\u00a0v<\/em>\u00a0Canada (Citizenship and Immigration),<\/strong>\u00a0<\/i>2019 FC 1230\u00a0\u00a0<a href=\"http:\/\/canlii.ca\/t\/j2kzr\">http:\/\/canlii.ca\/t\/j2kzr,\u00a0<\/a>Mr. B, a resident of Lebanon was applying for a study permit. His immediate family (parents) were in Canada on valid work permits and her three sisters were pursuing education in Quebec. He was admitted into the University of Montreal.<\/p>\n<p>One of the major reasons he was denied was that he had strong family ties in Canada and the Officer had concerns that the Applicant would be coming to Canada for reasons other than those stated in his application (at para 10).<\/p>\n<p>In assessing family ties,\u00a0 Justice Shore highlighted the Applicant\u2019s arguments (which were well made, I might add):<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-e95ae66 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"e95ae66\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-20b392a\" data-id=\"20b392a\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-6ebe5ca quotes elementor-widget elementor-widget-text-editor\" data-id=\"6ebe5ca\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<p><em>[12] The Applicant submits that it was unreasonable for the Officer to consider the parents\u2019 lawful status in Canada as a negative factor. In support of this submission, the Applicant refers to the Minister\u2019s Operational Instructions and Guidelines (OP-11 Guidelines, at page 13) which suggest a favourable consideration of family members with lawful status and stable employment in Canada.<\/em><\/p>\n<p><em>[13] The Applicant further argues that the Officer made an arbitrary decision based on unintelligible reasons when he failed to justify how the legal presence of the Applicant\u2019s parents in Canada warranted a negative consideration.<\/em><\/p>\n<p><em>[14] The Applicant also submits that the Officer failed to consider that the presence of the parents with valid work permits would likely ensure that the Applicant has sufficient financial support (Girn v Canada (Citizenship and Immigration), 2015 FC 1222 at para 32; Tavakoli Dinani v Canada (Citizenship and Immigration), 2012 FC 1063 at para 27; Demyati, above, at para 11).<\/em><\/p>\n<p><em>[15] In drawing a negative inference from the parents\u2019 status in Canada, the Officer also failed to consider that the Applicant may have a legitimate dual intent, as permitted by the IRPA at subsection 22(2).<\/em><\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-3cdd26e elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"3cdd26e\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-351574c\" data-id=\"351574c\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-438ca09 elementor-widget elementor-widget-text-editor\" data-id=\"438ca09\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<p>Justice Shore highlighted in analysis that the simple tying in of strong family ties to an individual remaining illegally was an unreasonable inference:<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-c2fd2b6 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"c2fd2b6\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-12abc12\" data-id=\"12abc12\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-fe266c5 quotes elementor-widget elementor-widget-text-editor\" data-id=\"fe266c5\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<p><em>(2) The Officer acted without regard to the evidence of the Applicant\u2019s current studies<\/em><\/p>\n<p><em>[33] The IRPA explicitly provides for the possibility of having a dual intent:<\/em><\/p>\n<p><em>22 (2) An intention by a foreign national to become a permanent resident does not preclude them from becoming a temporary resident if the officer is satisfied that they will leave Canada by the end of the period authorized for their stay.<\/em><\/p>\n<p><em>[34] In this case at hand, the Applicant has strong ties in Canada with well-established and legally established members of his family. This Court agrees with the Applicant\u2019s submissions as summarized above at paragraphs 12 to 15:\u00a0<strong>the Officer should not have drawn negative inferences from the Applicant\u2019s family ties in Canada. If anything, the Officer should have considered the financial support the Applicant\u2019s family provides as a positive factor. At the very least, the Officer should have justified his\/her reasoning: it is unreasonable to infer that Applicant will remain in the country illegally simply because he has strong family ties in Canada.<\/strong><\/em><\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-d98df26 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"d98df26\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-e909819\" data-id=\"e909819\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-98ac9d5 elementor-widget elementor-widget-text-editor\" data-id=\"98ac9d5\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<p>As set out in the beginning of the decision, in overview:<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-c65e836 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"c65e836\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-f2326d5\" data-id=\"f2326d5\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-d3e34dc quotes elementor-widget elementor-widget-text-editor\" data-id=\"d3e34dc\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<p><em>[2]\u00a0\u00a0In this case at hand, the Applicant has strong ties in Canada with\u00a0<strong>well-established and legally established members of his family<\/strong>. This Court agrees with the Applicant\u2019s submissions as summarized below at paragraphs 12 to 15: t<strong>he Officer should not have drawn negative inferences from the Applicant\u2019s family ties in Canada<\/strong>. If anything, the Officer should have considered the financial support the Applicant\u2019s family provides as a positive factor. At the very least, the Officer should have justified his\/her reasoning: it is unreasonable to infer that Applicant will remain in the country illegally simply because he has strong family ties in Canada.<\/em><\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-69236e9 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"69236e9\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-445a3df\" data-id=\"445a3df\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-bfc32f2 elementor-widget elementor-widget-text-editor\" data-id=\"bfc32f2\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<p><i>Bteich\u00a0<\/i>reminds us to a<strong>ctually present and assess the family members in Canada<\/strong>,<strong>\u00a0where they have status and where they are of financial support to the Applicant\u2019s proposed studies.<\/strong>\u00a0If there is concerns that the Officer will speculate on this tie, it may be worthwhile to highlight\u00a0Justice Shore\u2019s reasoning.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-def46e0 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"def46e0\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-54d830d\" data-id=\"54d830d\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-05cefd1 elementor-widget elementor-widget-text-editor\" data-id=\"05cefd1\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<p>In\u00a0<em><strong>Gauthier v. Canada (Citizenship and Immigration),<\/strong>\u00a0<\/em>2019 FC 1211 (CanLII), &lt;<a class=\"documentStaticUrl\" href=\"http:\/\/canlii.ca\/t\/j2sgg\">http:\/\/canlii.ca\/t\/j2sgg<\/a>&gt;, Justice Shore again raises a strong argument that family ties are at the heart of individual lives, but that it is not enough to simply consider it a risk of an individual not leaving Canada.\u00a0 In finding the refusal of a Haitian national applicant with a sister in Canada unreasonable, Justice Shore writes:<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-0bc7b6b elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"0bc7b6b\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-2c85244\" data-id=\"2c85244\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-1846487 quotes elementor-widget elementor-widget-text-editor\" data-id=\"1846487\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<p><em>[<a class=\"reflex-paragAnchor\" name=\"par18\"><\/a>18]\u00a0\u00a0To arrive at his findings, the immigration officer was entitled to consider all of the factors\u2014including family-related factors\u2014that could prompt the applicant to stay or not to stay in Canada at the end of her study permit. Since family lies at the heart of our lives, it is an important element in the determination of place of residence. It was therefore reasonable for the immigration officer to consider the applicant\u2019s family ties as a\u00a0<q class=\"decisia-wcag-quote-inline\"><span class=\"CitationCar\">\u201cpull factor\u201d<\/span><\/q>.<\/em><\/p>\n<div class=\"bootstrap unselectable viibes-marker-toolbox\" title=\"Paragraph tools\">\n<div class=\"container px-0\">\n<div class=\"dropleft\">\u00a0<\/div>\n<\/div>\n<\/div>\n<p class=\"ParagNum\" data-viibes-end=\"17\" data-viibes-parag=\"19\" data-viibes-start=\"18\"><em>[<a class=\"reflex-paragAnchor\" name=\"par19\"><\/a>19]\u00a0\u00a0However, in conducting this analysis, the immigration officer placed an unreasonable emphasis on this personal factor. Admittedly, the evidence on the record shows that her sister is in Canada and is prepared to host her; however, it cannot be concluded that the applicant is necessarily at risk of not leaving Canada at the end of her study permit.<\/em><\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-ecfcc9b elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"ecfcc9b\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-d92d3e5\" data-id=\"d92d3e5\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-f8de3d9 elementor-widget elementor-widget-text-editor\" data-id=\"f8de3d9\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<p>Finally, in\u00a0<em><strong>Peiro v. Canada (Citizenship and Immigration),<\/strong><\/em>\u00a02019 FC 1146 (CanLII), &lt;<a class=\"documentStaticUrl\" href=\"http:\/\/canlii.ca\/t\/j2fsr\">http:\/\/canlii.ca\/t\/j2fsr<\/a>&gt;, Justice Manson examined a refusal where the Officer highlighted the Applicant\u2019s brother, an international student in Canada, and determined it created strong family ties in Canada, even though the remainder of the family was Iran.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-fb98437 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"fb98437\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-f11f0db\" data-id=\"f11f0db\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-58f554a quotes elementor-widget elementor-widget-text-editor\" data-id=\"58f554a\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<p><em><strong>1.\u00a0\u00a0Family Ties<\/strong><\/em><\/p>\n<p class=\"ParagNum\" data-viibes-end=\"16\" data-viibes-parag=\"18\" data-viibes-start=\"17\"><em>[<a class=\"reflex-paragAnchor\" name=\"par18\"><\/a>18]\u00a0\u00a0Based on the record, the Applicant\u2019s only family in Canada is his younger brother, who is currently an international student in Vancouver. The Applicant\u2019s parents remain in Iran.<\/em><\/p>\n<div class=\"bootstrap unselectable viibes-marker-toolbox\" title=\"Paragraph tools\">\n<div class=\"container px-0\">\n<div class=\"dropleft\">\u00a0<\/div>\n<\/div>\n<\/div>\n<p class=\"ParagNum\" data-viibes-end=\"17\" data-viibes-parag=\"19\" data-viibes-start=\"18\"><em>[<a class=\"reflex-paragAnchor\" name=\"par19\"><\/a>19]\u00a0\u00a0The Minister argues that the Applicant is a single adult male with no spouse or dependants in Iran, and the record states that the Applicant was responsible for caring for his brother in Canada. The record is silent on the Applicant\u2019s brother\u2019s permit status, but as he is an international student, his stay in Canada is temporary.<\/em><\/p>\n<div class=\"bootstrap unselectable viibes-marker-toolbox\" title=\"Paragraph tools\">\n<div class=\"container px-0\">\n<div class=\"dropleft\">\u00a0<\/div>\n<\/div>\n<\/div>\n<p class=\"ParagNum\" data-viibes-end=\"18\" data-viibes-parag=\"20\" data-viibes-start=\"19\"><em>[<a class=\"reflex-paragAnchor\" name=\"par20\"><\/a>20]\u00a0\u00a0The Officer\u2019s reasons with respect to family ties provide no reasonable basis for his position. While the officer mentioned family ties, he did not explain how the temporary presence of the Applicant\u2019s brother in Vancouver would outweigh the Applicant\u2019s family ties to Iran, which include his parents and family business which he intends on returning to after his studies.<\/em><\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-e2a8d53 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"e2a8d53\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-a25b027\" data-id=\"a25b027\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-184f66b elementor-widget elementor-widget-text-editor\" data-id=\"184f66b\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<p>Again this case suggests that parsing out as well\u00a0<strong>who has status in what country\u00a0<\/strong>in addition to simply indicating their names is important. I suggest letters of explanation and support where pertinent as well copies of identification (passport bio-data pages, and permits). One thing I have been doing more of is having the family members inside and outside Canada writing with assurances of compliance.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-8345587 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"8345587\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-651d71f\" data-id=\"651d71f\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-4984f95 elementor-widget elementor-widget-text-editor\" data-id=\"4984f95\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<p>A recent case you will likely see the Minister rely on is the case of\u00a0<em><strong>Hajiyeva v. Canada (Citizenship and Immigration),<\/strong>\u00a0<\/em>2020 FC 71 (CanLII), &lt;<a class=\"documentStaticUrl\" href=\"http:\/\/canlii.ca\/t\/j4vm2\">http:\/\/canlii.ca\/t\/j4vm2<\/a>&gt;<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-dfff9fe elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"dfff9fe\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-adc3d07\" data-id=\"adc3d07\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-d637d94 elementor-widget elementor-widget-text-editor\" data-id=\"d637d94\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<p>In the case of Ms. Hajiyeva, as is the case with many potential international students, she sought to come to Canada alongside her spouse and children.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-9d6ee1c elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"9d6ee1c\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-669a385\" data-id=\"669a385\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-d85f4e4 elementor-widget elementor-widget-text-editor\" data-id=\"d85f4e4\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<p>Justice Diner writes:<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-47749df elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"47749df\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-186e9d0\" data-id=\"186e9d0\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-2ae0d4e quotes elementor-widget elementor-widget-text-editor\" data-id=\"2ae0d4e\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<p><em>[<a class=\"reflex-paragAnchor\" name=\"par5\"><\/a>5]\u00a0\u00a0Ms. Hajiyeva argues that the Officer ignored evidence, and failed to provide adequate reasons relying on\u00a0Omijie v Canada (Citizenship and Immigration),\u00a0<span class=\"reflex3-block\"><a class=\"reflex3-caselaw\" href=\"https:\/\/www.canlii.org\/en\/ca\/fct\/doc\/2018\/2018fc878\/2018fc878.html\"><span class=\"reflex3-alt\">2018\u00a0FC\u00a0878<\/span><\/a>, at para\u00a0<a class=\"reflex-parag\" href=\"https:\/\/www.canlii.org\/en\/ca\/fct\/doc\/2018\/2018fc878\/2018fc878.html#par26\">26<\/a>\u00a0[Omijie]<\/span>. I find, however, that this case differs from\u00a0Omijie. First, while the Applicant\u2019s parents and brother would remain in Azerbaijan, her immediate family (husband and children) would join her in Canada; she indicated her husband would obtain a work permit and gain international work experience, and her children would attend school and be exposed to Canadian values. The Officer\u2019s finding regarding her incentives to remain in Canada were reasonable. Here, the finding that her evidence and supporting documentation fell short of demonstrating that she would leave Canada at the end of her study period was open to the Officer.<\/em><\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-646adaa elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"646adaa\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-e30fc55\" data-id=\"e30fc55\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-5b6dddb elementor-widget elementor-widget-text-editor\" data-id=\"5b6dddb\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<p>In cases such as these, there may simply be no way to overcome the pure mathematics of the family members (and their closeness) vis-a-vis the plan and the country of origin.
