{"id":9851,"date":"2025-01-31T15:38:18","date_gmt":"2025-01-31T23:38:18","guid":{"rendered":"https:\/\/heronlaw.ca\/success_stories\/heron-law-success-story-how-a-mandamus-demand-letter-resulted-in-a-client-obtaining-pr\/"},"modified":"2025-01-31T15:38:18","modified_gmt":"2025-01-31T23:38:18","slug":"heron-law-success-story-how-a-mandamus-demand-letter-resulted-in-a-client-obtaining-pr","status":"publish","type":"success_stories","link":"https:\/\/heronlaw.ca\/zh-hans\/success_stories\/heron-law-success-story-how-a-mandamus-demand-letter-resulted-in-a-client-obtaining-pr\/","title":{"rendered":"Heron Law Success Story: How a Mandamus Demand Letter Resulted In a Client Obtaining PR"},"content":{"rendered":"\n<p><strong><em>By Karina Juma, Articling Student<\/em><\/strong><\/p>\n\n\n\n<p>We have been seeing an increase in wait times between the submission of permanent residence (\u201cPR\u201d) applications and applicants receiving a decision on their applications, particularly for applicants from certain countries who are being triaged for the <strong>comprehensive security screening<\/strong> process.<\/p>\n\n\n\n<p>One of our clients submitted his PR application under the <strong>Provincial Nominee Program (\u201cPNP\u201d)<\/strong> in December 2022. The average processing time for PNP applications posted on Immigration, Refugees and Citizenship Canada (\u201cIRCC\u201d)\u2019s website is <strong>6 months<\/strong>.<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter size-full is-resized\"><img loading=\"lazy\" src=\"https:\/\/heronlaw.ca\/wp-content\/uploads\/2025\/01\/Screenshot-2025-01-31-at-2.53.31\u202fPM.png\" alt=\"\" class=\"wp-image-8563\" width=\"490\" height=\"444\" srcset=\"https:\/\/heronlaw.ca\/wp-content\/uploads\/2025\/01\/Screenshot-2025-01-31-at-2.53.31\u202fPM.png 490w, https:\/\/heronlaw.ca\/wp-content\/uploads\/2025\/01\/Screenshot-2025-01-31-at-2.53.31\u202fPM-300x272.png 300w\" sizes=\"(max-width: 490px) 100vw, 490px\" \/><\/figure><\/div>\n\n\n\n<p><\/p>\n\n\n\n<p>Around eight months later after submitting their application, the client was asked to provide additional documents about their past <strong>government employment<\/strong> in their country of origin. The client provided the requested documents and they were soon after placed into a comprehensive security check.<\/p>\n\n\n\n<p>The client made multiple efforts to follow-up with the status of their PR application, including submitting webforms and involving their local Member of Parliament to liaise with IRCC on their behalf, but they <strong>never received any meaningful explanation<\/strong> about why their application was delayed.<\/p>\n\n\n\n<p>The client retained our office and we submitted a <strong>demand letter<\/strong> to IRCC highlighting the <strong>significant prejudice<\/strong> the client and their family had suffered from the processing delay.<\/p>\n\n\n\n<p>We advised IRCC in our letter that we would be filing a <strong>mandamus application<\/strong> at the Federal Court if no update was provided to the client within a few weeks.<\/p>\n\n\n\n<p>Having received no response from IRCC, we filed an application for leave and for judicial review (\u201cAFLJR\u201d) requesting an order of <strong>mandamus<\/strong> compelling IRCC to continue processing the client\u2019s PR application.<\/p>\n\n\n\n<p>After receiving the Rule 9 Reasons \u2013 in this case, there were no reasons due to being a mandamus case \u2013 the client received a letter from IRCC inviting them to <strong>confirm their PR status<\/strong> in the online portal.<\/p>\n\n\n\n<p>After nearly two years of delay, the client and their family could finally <strong>move forward<\/strong> with their lives in Canada as permanent residents, thanks to a nudge from our office. &nbsp;<\/p>\n\n\n\n<p><em>This client later then provided us with a 5-star Google review for this matter:<\/em><\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" width=\"625\" height=\"397\" src=\"https:\/\/heronlaw.ca\/wp-content\/uploads\/2025\/02\/image.png\" alt=\"\" class=\"wp-image-8699\" srcset=\"https:\/\/heronlaw.ca\/wp-content\/uploads\/2025\/02\/image.png 625w, https:\/\/heronlaw.ca\/wp-content\/uploads\/2025\/02\/image-300x191.png 300w\" sizes=\"(max-width: 625px) 100vw, 625px\" \/><\/figure>\n\n\n\n<p><strong>If your immigration application is delayed, contact Heron Law Offices today for a consultation to determine your options. <\/strong><\/p>\n\n\n\n<p><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Our client&#8217;s PR application was finalized after we sent IRCC a demand letter highlighting the steps the client had taken to follow-up with their application since submission and the prejudice they had suffered due to the delay.
