Because of extenuating circumstances, the Applicant required additional time to finish the final term of their graduate studies program and applied for a study permit extension self-represented.<\/p>\n\n\n\n<p>Due to technical difficulties with accessing the portal because of IRCC\u2019s two-factor authentication, the Applicant missed <strong>a request from IRCC<\/strong> to provide <strong>proof of payment of the biometrics fee within a 7-day deadline<\/strong>. The client missed the upload deadline by merely three days and the study permit extension application was refused on the basis that the client did not provide all the information as required under section 16(1) of the <em>Immigration and Refugee Protection Act. <\/em>The client did, however, provide the required proof of payment in their portal <em><strong>before<\/strong><\/em> a negative decision was made.<\/p>\n\n\n\n<p>Our office was retained to submit <strong>a reconsideration request<\/strong> for the study permit extension refusal on the basis that IRCC made a clerical error. We helped our client prepare <strong>a letter of explanation<\/strong> and drafted legal submissions on their behalf in support of the request as well as submitted the request to IRCC.<\/p>\n\n\n\n<p>Our office also submitted an application that the client\u2019s status be restored, or alternatively, that the client be issued a Temporary Resident Permit (\u201cTRP\u201d).<\/p>\n\n\n\n<p>Our client\u2019s reconsideration request and study permit restoration application were <strong>approved<\/strong> earlier this month, allowing the client to complete their program of study in Canada.&nbsp; &nbsp;&nbsp;<\/p>\n\n\n\n<p>If you are facing a complex issue with your immigration journey, contact Heron Law Offices today for a consultation to discuss how we can help you.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Our lawyer, Laura Schemitsch, successfully assisted a client in overturning a study permit extension refusal and restoring their student status in Canada.
